WellAtlas Canada — Terms of Use

These terms apply to the WellAtlas Canada mobile applications for iOS and Android (the "App"). By using the App you agree to them. If you do not agree, do not use the App.

1. Who we are

The App is operated by 10591203 CANADA CORP. (the "Operator", "we"). WellAtlas Canada is an independent application and is not affiliated with or endorsed by the Government of Canada or any provincial or territorial government.

2. What the App does

The App displays publicly available water-well records published by Canadian governments, lets you search and filter them, summarizes nearby records statistically, and lets you save records on your device. It is an information service. It does not drill wells, test water, or give professional advice.

3. The well records and their licence

The well records shown in the App come from public government datasets. Each record names the government that published it, the dataset version it came from, and the licence it is published under. For Ontario, the records are provided under the Open Government Licence – Ontario, and the App displays the attribution that licence requires.

Those government licences are granted directly by the publishing government to everyone, including you. These terms neither add to nor take away from the rights that a government licence gives you in the records. If you want to reuse the records themselves, obtain them from the original government source under its licence; you do not need our permission and we cannot give you any right the government has not.

What the Operator does own is the App itself: its design, code, text, translations, map styling, the way records are organized and normalized, and the statistical summaries and other content the App generates. Except where a government or open-source licence says otherwise, you may not copy, resell, or redistribute that material without our written permission.

4. The information may be wrong

Well records are reported by the people who drilled, altered, or abandoned a well and are transcribed by governments. They may be incomplete, inaccurate, outdated, or spatially approximate. Most mapped positions are approximate, and the App marks them as such.

Information in the App must not be used as the sole basis for drilling, engineering, regulatory, environmental, property-purchase, or drinking-water decisions. Verify important information with the original government source and an appropriate qualified professional. Nothing in the App says whether water is safe to drink.

Statistical summaries describe the nearby records that exist; they do not predict what will be found at any particular property.

5. Acceptable use

You may use the App for any lawful purpose. You must not:

• attempt to identify or contact the owner or occupant of a property from a well record, or use the App to harass, stalk, or intrude on anyone;
• interfere with the App's services, for example by circumventing rate limits or automated-access controls;
• misrepresent the App or its content as an official government service; or
• remove or obscure the attribution or source information the App displays.

6. Your device and your data

The App does not require an account. Saved wells and recent searches are stored only on your device. Your location is read only when you tap "Use my location" and is not stored by the App or sent to us with your identity. The App's Privacy screen describes this in full and forms part of these terms.

7. Paid features

Some features may be offered as paid subscriptions through the Apple App Store or Google Play. Prices, billing, renewal, and refunds are governed by the store's terms. Paid features add tools and convenience built by the Operator; they never sell you access to the government records themselves, which remain available to everyone under their government licences.

8. Third-party components

The App uses open-source software and map data from third parties under their own licences, which are listed in the App under Sources and licences. Base maps are provided by third-party services and are not part of the government well records.

9. Availability and changes

We may change, suspend, or discontinue any part of the App at any time, and we may update these terms. The version date at the top tells you when they last changed. Continuing to use the App after a change means you accept the updated terms.

10. No warranty; limitation of liability

The App and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, the Operator is not liable for any loss or damage — including loss arising from decisions made in reliance on information in the App — whether in contract, tort, or otherwise. Where liability cannot be excluded, it is limited to the amount you paid the Operator for the App in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations; in those places the exclusions and limitations apply only to the extent permitted.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts of Ontario have exclusive jurisdiction over any dispute, without prejudice to any consumer-protection rights you have where you live.
